Rating: +1

Bill Summary:

House Bill 212 amends Section 33-2704 of Idaho Code to revise the petitioning requirements for the creation of a new public library district. Previously, a fixed minimum of 50 signatures from qualified electors residing within the proposed district boundaries was required to initiate the process. This bill replaces that threshold with a percentage-based requirement, specifying that at least 20% of qualified electors within the proposed district must sign the petition.

The bill maintains all other procedural elements for the formation of a library district, including:

  • Submission of a formal petition with district boundaries and a map,
  • Verification of petition signatures,
  • Public hearings with opportunity for objections and testimony,
  • Required notice to existing tax-supported libraries in the affected area.

The county commissioners retain final authority to approve or modify district boundaries based on the hearing and state library policy goals. The bill is enacted with an emergency clause, taking effect July 1, 2025.

Reason for Rating:

HB 212 strengthens local control and community engagement, key principles in the Idaho Republican Party Platform. By shifting from a flat 50-signature threshold to a proportional standard, the bill ensures that rural or sparsely populated areas are not disadvantaged in pursuing localized services. It promotes grassroots governance, public accountability, and preserves checks and balances through the public hearing process.
